This is a plain-language summary. It is not a substitute for the full Terms below.
- You can use KidsMealDeals to find and submit kids meal deals at restaurants.
- You're responsible for your account and anything you submit.
- Don't submit false, misleading, or harmful content. Don't impersonate restaurants or other people.
- Restaurants come and go, deals change without notice. We can't guarantee any deal is currently honored. Always confirm with the restaurant.
- We may remove content, suspend accounts, or ban users who violate these Terms.
- The Service is provided "as is." We're not liable for amounts beyond what you've paid us in the past 12 months (which is zero for free users).
- Most disputes will be handled by individual arbitration, not class actions or court — but you can opt out of arbitration within 30 days of creating your account.
1. The agreement
These Terms of Service ("Terms") form a binding agreement between you and KidsMealDeals ("we," "us," or "our") regarding your use of the website at kidsmealdeals.com, our APIs, and any related services (collectively, the "Service").
By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.
We may update these Terms from time to time. If we make material changes, we'll notify you (see General). Continued use of the Service after changes take effect means you accept the updated Terms.
2. Who can use KidsMealDeals
You must be at least 13 years old to use the Service. If you're between 13 and 18, you must have permission from a parent or legal guardian.
You must not be barred from using the Service under any applicable law (including U.S. export controls and sanctions lists). You're responsible for complying with the laws in your jurisdiction.
3. Your account
You can browse the Service without an account, but creating an account is required to:
- Submit deals or restaurants
- Save preferences and favorites
- Earn points (see Points & rewards)
- Subscribe to email digests
- Access any future paid features
When you create an account, you agree to:
- Provide accurate, current information.
- Keep your password confidential. You're responsible for all activity under your account.
- Notify us immediately at kidsmealdeals@gmail.com if you suspect unauthorized use.
- Maintain only one account. Multiple accounts created to evade rate limits or bans are prohibited.
You can close your account at any time from your profile settings or by emailing kidsmealdeals@gmail.com.
4. User submissions
"User Submissions" means anything you contribute to the Service: restaurants, deals, photos, votes, flags, comments, profile information, and any other content.
Your representations
By submitting content, you represent and warrant that:
- The content is accurate to the best of your knowledge at the time of submission.
- You have the right to submit it (you own the photo or have permission to share it; the deal information is not subject to confidentiality).
- The content does not violate any law or anyone's rights, including intellectual property and privacy rights.
- You're not being paid by the restaurant to submit a deal as a regular user — restaurants and their representatives must use the official paid promotion features (see Paid features).
License to your submissions
When you submit content, you grant KidsMealDeals a worldwide, non-exclusive, royalty-free, sublicensable, perpetual, and irrevocable license to host, store, reproduce, modify (for formatting and moderation), distribute, publicly display, and create derivative works of your User Submissions, for any purpose related to operating, improving, and promoting the Service.
This license is necessary because user-verified deal data is the core of the Service — if a single contributor could revoke the license to a deal that hundreds of other users have voted on, the integrity of the directory would collapse. The license survives the termination of your account.
Anonymized retention
If you delete your account, we may retain your User Submissions in anonymized form (with your display name replaced) so that community-verified deal data remains intact for other users.
5. Voting and flagging
Anyone can vote that a deal is "still valid" or "no longer valid" and flag deals as inaccurate, expired, or otherwise problematic. To prevent abuse, we apply rate limits to all voting and flagging activity. Anonymous (signed-out) users have stricter limits than registered users.
You agree to vote and flag in good faith. You will not:
- Cast votes for deals you have not personally verified.
- Flag deals that are accurate to harm a restaurant or competitor.
- Coordinate vote brigades or use multiple accounts to manipulate signals.
- Use automated tools to vote or flag.
Violations may result in vote/flag removal, account suspension, or permanent ban.
6. Points & rewards
The Service includes a points program that rewards users for contributions.
How points are earned
- Submission approved: points are awarded when a deal you submit is approved by our team.
- Vote on a verified deal: if you voted "still valid" on a deal that our team later marks as KMD verified, you earn points retroactively (within a 90-day window before the verification, subject to anti-gaming rules).
- Discretionary bonuses: we may award points for milestones, contests, or other events at our discretion.
Important rules
- Points have no cash value. They cannot be redeemed for money, transferred to other users, or sold.
- Redemption is not currently available. A redemption program (gift card raffles or similar) is planned for a future release. We do not guarantee that redemption will launch on any particular date or with any particular reward structure.
- Points may be revoked if we determine they were earned through fraudulent activity, gaming, or violation of these Terms.
- Points expire 24 months after the last point-earning activity on your account, unless you maintain activity.
- We may modify or discontinue the points program at any time with reasonable notice. If the program is discontinued, you'll have at least 30 days to redeem any then-available rewards (if a redemption mechanism is then live).
7. What's not allowed
You may not, and you may not enable or assist others to:
- Submit false, misleading, or fraudulent deals or restaurants.
- Impersonate any person, restaurant, or organization.
- Submit content that is unlawful, defamatory, harassing, threatening, hateful, or invades anyone's privacy.
- Post content that exploits, sexualizes, or endangers minors.
- Post spam, advertising for unrelated products, links to malware or phishing sites, or pyramid/MLM schemes.
- Use the Service to violate any law or the rights of any third party.
- Attempt to gain unauthorized access to the Service, other users' accounts, or our infrastructure.
- Probe, scan, or test the vulnerability of our systems without our written permission. (Responsible security disclosures are welcome — email kidsmealdeals@gmail.com.)
- Scrape, crawl, or harvest data from the Service except (a) by complying with our robots.txt and any published API rate limits, or (b) with our written permission.
- Use the Service in any manner that could disable, overburden, damage, or impair it.
- Use any automated means (bots, scripts) to interact with the Service, except for an official, documented API.
- Reverse-engineer, decompile, or attempt to derive source code from the Service, except as expressly permitted by law.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notice.
- Resell, sublicense, or commercially exploit the Service or its content without our written permission.
8. Our moderation rights
We reserve the right (but not the obligation) to review, edit, or remove any User Submission, and to suspend or terminate accounts that violate these Terms or harm the community.
Specifically, we may:
- Approve, reject, or edit submissions to standardize formatting, fix typos, or correct factual errors.
- Mark deals as "KMD verified" after our team confirms them. This is our determination at our sole discretion.
- Mark deals as "promoted" if a restaurant has paid for placement.
- Hide auto-flagged deals from search results pending moderator review.
- Remove content for any reason, including violation of these Terms or to comply with law.
- Impose stricter rate limits on accounts we believe are abusive.
- Suspend or permanently ban accounts.
We don't guarantee that we will review all submissions or take action on every report. The community-moderation system supplements but does not replace our editorial discretion.
9. Third-party content and links
The Service displays information about restaurants and their offerings. We are not affiliated with the restaurants featured (unless explicitly noted as a partnership). Restaurant names, logos, and trademarks belong to their respective owners and are used to identify the businesses.
The Service may contain links to third-party websites and services we don't control. We're not responsible for their content, policies, or practices. Use them at your own risk.
Any reviews, opinions, or community-submitted content reflect the views of the contributors, not us.
10. Paid features
The core Service is free for families. Some features may require a paid subscription. Paid features planned for a future release include:
- Restaurant owner portal with promoted deals, available to verified restaurant owners on a subscription basis.
- Premium ad-free tier for users who want to use the Service without advertisements.
When paid features launch, the following will apply:
- Pricing. Current pricing will be displayed at the point of subscription. We may change pricing with at least 30 days' notice for existing subscribers.
- Billing. Subscriptions are billed in advance through our payment processor (Stripe). Recurring charges continue until you cancel.
- Cancellation. You can cancel at any time from your account settings. Cancellation takes effect at the end of your current billing period.
- Refunds. We do not generally offer refunds for partial billing periods. We may issue refunds at our discretion if there is a billing error or material failure of the Service.
- Free trials. If we offer a free trial, we'll disclose the terms before you start. After the trial ends, your subscription will automatically renew at the standard price unless you cancel before the trial ends.
- Taxes. Prices are exclusive of applicable taxes. You're responsible for any taxes that apply to your subscription.
Paid features are subject to all of these Terms in addition to any specific terms presented at signup.
11. Advertising
The free version of the Service is supported by advertising. By using the Service, you understand that ads will be displayed on most pages.
We don't endorse advertised products or services. Your interactions with advertisers are between you and them; we're not a party to those transactions.
If you want an ad-free experience, you can subscribe to the premium tier when it becomes available (see Paid features).
12. Our intellectual property
Except for User Submissions, the Service and all its content — including code, design, graphics, logos, the "KidsMealDeals" name and smiley logo, the "KMD verified" mark, text, and the database structure — are owned by KidsMealDeals or its licensors and are protected by intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use, subject to these Terms.
We retain all rights not expressly granted. Nothing in these Terms transfers any ownership of our intellectual property to you.
13. DMCA / copyright
We respect the intellectual property rights of others. If you believe content on the Service infringes your copyright, send a notice to our designated agent at kidsmealdeals@gmail.com with the following information:
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the allegedly infringing material, with enough detail for us to locate it (URL is best).
- Your contact information (name, address, phone, email).
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
- Your physical or electronic signature.
We will respond to valid notices and may remove allegedly infringing content. We may also terminate the accounts of users who repeatedly infringe.
If your content was removed and you believe in good faith that it was a mistake or misidentification, you can submit a counter-notification with the elements required by 17 U.S.C. § 512(g)(3).
14. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law:
You acknowledge that:
- Deal information is community-submitted and may be inaccurate, outdated, or fraudulent despite our moderation efforts.
- "KMD verified" status indicates that our team confirmed the deal at a specific point in time, not that the deal will continue to be honored.
- Restaurants may change, end, or refuse to honor advertised deals at their discretion.
- Geographic, hours, contact, and other restaurant information may be inaccurate or outdated.
- You are responsible for confirming any deal with the restaurant before relying on it.
15. Limitation of liability
This limitation applies regardless of the legal theory (contract, tort, statute, or otherwise) and even if we have been advised of the possibility of such damages.
Some jurisdictions don't allow the exclusion of certain warranties or limitations of liability for incidental or consequential damages. If you live in such a jurisdiction, some of the exclusions and limitations above may not apply to you, and you may have additional rights.
16. Indemnification
You agree to defend, indemnify, and hold harmless KidsMealDeals and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service;
- Your User Submissions;
- Your violation of these Terms;
- Your violation of any law or the rights of any third party.
We reserve the right to assume the exclusive defense and control of any matter you would otherwise be required to indemnify, in which case you agree to cooperate with our defense.
17. Termination
You may stop using the Service or close your account at any time.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including:
- Violation of these Terms;
- Conduct that harms other users or the integrity of the Service;
- Legal or regulatory requirements;
- Long inactivity (we may close accounts inactive for over 24 months).
Sections that by their nature should survive termination — including User Submissions licensing, Disclaimers, Limitation of liability, Indemnification, and Disputes & arbitration — will survive any termination of these Terms.
18. Disputes & arbitration
Informal resolution
Before formal dispute resolution, you agree to try to resolve the dispute informally by emailing us at kidsmealdeals@gmail.com with a description of the issue and how you'd like it resolved. We'll do the same if we have a dispute with you. We agree to negotiate in good faith for at least 60 days before either party initiates formal proceedings.
Binding arbitration
If the dispute is not resolved informally, you and KidsMealDeals agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
The arbitration will be conducted in English, in the U.S. county where you reside (or another mutually agreed location). For Disputes under $10,000, the arbitration will be conducted by document submission unless you request a hearing.
No class actions
You and KidsMealDeals agree that each may bring claims only in your or our individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Exceptions
Either party may bring an individual claim in small-claims court instead of arbitration, as long as the claim qualifies. Either party may seek injunctive relief in court for intellectual property infringement, unauthorized access to or misuse of the Service, or to enforce confidentiality obligations.
Opt-out
You can opt out of this arbitration agreement within 30 days of first accepting these Terms by sending us a written opt-out notice from your account email to kidsmealdeals@gmail.com with the subject "Arbitration Opt-Out." If you opt out, neither you nor we are bound by the arbitration agreement, but the rest of these Terms still apply.
Governing law and venue
These Terms and any Dispute will be governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. If a Dispute is not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in Columbus, Ohio.
19. General
Changes to the Terms
We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. For material changes, we'll notify users with active accounts by email at least 14 days before the changes take effect, and post a notice on the homepage for 30 days. Continued use after the effective date means you accept the updated Terms.
Entire agreement
These Terms, together with the Privacy Policy and any other terms presented to you for specific features, are the entire agreement between you and us regarding the Service and supersede any prior agreements.
Severability
If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or, if it can't be modified, it will be severed. The rest of the Terms will remain in effect.
No waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
Assignment
You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, acts of war, civil unrest, internet or infrastructure outages, or actions of governmental authorities.
Notices
We may give notices to you by posting them on the Service, sending email to your account address, or any other reasonable means. You can give notices to us by emailing kidsmealdeals@gmail.com.
